Please read the terms and conditions of this agreement carefully before using the resume builder web service ("Service"). Your use of this Service constitutes your assent to and acceptance of this Agreement.

By using the services available at this site or by making the services available to authorized users, you agree to comply with the following terms and conditions (the "Agreement"). For purposes of this Agreement, the "Service Provider" includes the company, institution, or entity that makes available the Services available at this site and any other company, partner, or entity that is also involved in making the Services available at this site. Please review these terms of use periodically as the Service Provider may revise these Terms of Use from time to time.

1. Grant of License
Subject to the terms of this Agreement, the Service Provider grants you the non-exclusive, nonsublicensable right to use the Service only in accordance with the documentation and terms provided herein. Each company, organization, and entity involved in providing the Service retains title to and ownership to their respective copyrights, patent rights, trademark rights and other proprietary rights with respect to Service and all respective material located on Service web sites. You agree not to transmit any unlawful, libelous, harassing, sexually and/or racially offensive, abusive, obscene, threatening, harmful, privacy invading, vulgar, or otherwise objectionable material of any kind while using the Service. You agree not to transmit "unsolicited e-mail," "spam," "chain letters", or mass distribution of e-mail, or to use the Service for any commercial purposes. You agree not to impersonate any other person while using the Service. Any violation of these terms warrants immediate termination of service and may subject you to other charges or fines if applicable.

2. Restrictions
You may not copy any portion of any material on the Service, except as required to use the web site in accordance with this agreement and except for one copy of your information solely for back-up purposes.

(a) You may NOT (and shall not knowingly allow any third party to) modify, or create a derivative work of any part of the Service.

(b) You may NOT (and shall not knowingly allow any third party) to RENT, LEASE OR USE THE SERVICE IN A BUSINESS OR FOR COMMERCIAL PURPOSES WITHOUT FIRST OBTAINING A BUSINESS LICENSE.

(c) You may NOT (and shall not knowingly allow any third party to) reverse engineer, decompile, disassemble or otherwise attempt to reconstruct or discover any source code, underlying ideas, algorithms, file formats or programming interfaces of any portion of Service.

3. Term This Agreement will remain in effect unless it is terminated by either party. Upon termination of Service you will cease to use of Service. You agree that the Service Provider, in its sole discretion, may terminate your account or use of the Service, and remove and discard any information you have provided for any reason, including, without limitation, lack of use or if the Service Provider believes that you have violated or acted inconsistently with the spirit of the terms herein. The Service Provider may at any time discontinue providing the Service, or any part thereof, with or without notice. You agree to allow the Service Provider the right to terminate your access to the service under any provision of this Agreement without prior notice, and acknowledge and agree that the Service Provider may immediately deactivate or delete your account and all related information in your account and/or bar any further access to such files or the Service. You agree that the Service Provider shall not be liable to you or any third party for any termination of your access to the Service.

4. Warranty
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. THE SERVICE PROVIDER MAKES NO WARRANTY THAT THE SERVICE WILL MEET USER REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES THE SERVICE PROVIDERMAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE. THE SERVICE PROVIDERASSUMES NO RESPONSIBILITY FOR AND MAKES NO WARRANTY OR REPRESENTATION AS TO THE ACCURACY, CURRENCY, COMPLETENESS, RELIABILITY, USEFULNESS OR DECENCY OF CONTENT OR PRODUCTS DISTRIBUTED OR MADE AVAILABLE BY THIRD PARTIES (INCLUDING BUT NOT LIMITED TO ADVERTISERS) THROUGH THE SERVICE. YOU UNDERSTAND AND AGREE THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK. YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER OR LOSS OF DATA THAT RESULTS FROM ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE. THE SERVICE PROVIDER MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE SERVICE PROVIDEROR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. SOME STATES DO NOT ALLOW EXCLUSIONS OF CERTAIN WARRANTIES AND LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

5. Limitation of Liability
THE SERVICE PROVIDER SHALL NOT BE RESPONSIBLE OR LIABLE UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY: (A) FOR LOSS OR INACCURACY OF DATA, (B) FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING, BUT NOT LIMITED TO LOSS OF PROFITS, OR (C) FOR ANY MATTER BEYOND ITS REASONABLE CONTROL. You agree to indemnify and hold the Service Provider, their officers, partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the content you have submitted, or your use of the Service.

6. General
This is the entire agreement regarding your Service. If any provision of this Agreement is found to be unenforceable or invalid, the balance of this Agreement shall remain enforceable according to its terms. This Agreement shall be governed by the laws of the State of California and the United States without regard to conflicts of laws provisions thereof and without regard to the United Nations Convention on Contracts for the International Sale of Goods. The prevailing party in any action to enforce this Agreement shall be entitled to recover costs and expenses, including attorneys' fees. The Service shall not be exported except in compliance with all applicable export laws and regulations. Copyright (c) 2000-2008. Use, duplication or disclosure by the U.S. Government is subject to restrictions set forth in subparagraphs (a) through (d) of the Commercial Computer-Restricted Rights clause at FAR 52.227-19 when applicable, or in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013, and in similar clauses in the NASA FAR Supplement.

Our goal is to be your trusted location on the Internet for creating, updating and storing your resume. When you visit ResumeMakerPro.com, you are providing personal information to Individual Software Inc. and we want you to be aware of how carefully we handle this information.

Anonymous Information
In the aggregate, we gather demographic and profile information about visits to our site collectively. This information is gathered anonymously and is not linked to you as an individual. This information provides summarized statistics such as how many people visit our site, which features are used most frequently, and which browsers are primarily used. This information assists us in diagnosing problems with our site and helps us deliver a better overall experience for you and other visitors.

Registration
At your request, we save your sign-in information as a piece of data, or cookie, on your computer so that each time you return you will not need to re-enter your registration information. Due to the very personal nature of resume information, we understand how critical it is to keep your information confidential. You have complete control over what information you provide to ResumeMakerPro.com. We collect information that you voluntarily give us such as: name, address, phone numbers, e-mail address, web links and billing information via orders, product registration, e-mail or other direct contact from you, as well as all information that is contained on your resume(s) stored on this site. This information is used exclusively to create your resume and perform other services at your request. Individual Software is the sole owner of all the information entered at ResumeMakerPro.com and will not sell, share, or rent this information to any third parties, unless required to comply with a legal process such as a court order, subpoena or search warrant.

Password Protection
Your profile is password protected so that only you can access it. We recommend that you do not provide your password to anyone, as you are ultimately responsible for maintaining the secrecy of your account information. If you share a computer with someone else or are using a computer in a public location, remember to sign out and close your browser window when you have finished to ensure that others cannot access your personal information.

Public vs. Private
Once you have created a resume, you will have the option of choosing a Public or Private setting. The Private setting will prevent anyone other than you from viewing your online resume. The Public setting makes your online resume viewable by selected hiring employers. Although we use our best efforts to grant access to resumes only to appropriate people, we cannot guarantee that only these people will have access to your resume. At any time, you may reset the Public setting to Private, however, we are not responsible for the actions of any third parties that accessed your resume either while it is Public or Private.

E-mail Communications
Your e-mail address is used for the following communication. In every e-mail we send, it is our policy to have instructions on how to unsubscribe so that you will not receive any future e-mail messages:

• Send confirmation of your account creation, renewal or profile changes
• Occasionally send information about new services at ResumeMakerPro.com
• At your request, remind you to update your resume on a regular interval
• At your request, send additional information about career-related products and services

Security
The importance of security for your personally identifiable information is of utmost concern to us. We exercise great care in facilitating a secure transmission from your PC to our servers and go to extensive lengths to protect the loss, misuse or alteration of the information you provide. Individual Software owns and operates the servers used to host ResumeMakerPro.com exclusively. Your information is secured in a database behind a protective firewall, locked up and monitored in an alarmed building.

However, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, Individual Software Inc. can not ensure or warrant the security of any information you transmit to us and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems. When credit card information is transmitted we use industry standard, SSL (secure socket layer) encryption.

If you have selected to automatically renew your account each year, your credit card information will be encrypted and stored on our secure server in order to process future transactions. At any time, you may delete your account and all personal and credit card information will be removed from our system.

ResumeMakerPro.com may contain links to various career-related resources and Web sites. Additionally, ResumeMakerPro.com may offer co-branded Web sites which contain both the ResumeMaker and a partner's logo. Individual Software is not responsible for the privacy policies at these sites and we encourage you to review the privacy policies at these sites to understand exactly how they collect and use personally identifiable information.

Account Update or Removal
At any time, you may access your account to update your personal information by visiting and signing-in to ResumeMakerPro.com. If you would like to be completely removed from our database and no longer receive communication or service from ResumeMakerPro.com, then delete your account. If you are having trouble accessing your account, please contact Individual Software's Customer Service department.
